- Eligibility
- 1.1 The Affiliate Program is open to qualified individuals and professionals including:
- Licensed real estate agents
- Chartered accountants
- Certified lawyers
- Legal advisors
- Notary Public (Lekha Pramanik)
- Land Revenue Office (Malpot) / Government Officials
- Surveyor or Engineer (optional, for land/building verification)
- Bank or Financial Institution (if a loan or mortgage is involved)
- Other approved individuals or businesses as determined by KOTHAA CHA such as:
- Construction Companies and Contractors
- Property Developers
- Travel and Relocation Agencies
- Interior Designers and Furniture Stores
- Colleges and Universities
- 1.2 Affiliates must be legally capable of entering into binding agreements under the laws of Nepal.
- Commission Structure
- 2.1 The total commission on each successful property sale facilitated through the KOTHAA CHA platform is 100%, from which:
- The Affiliate receives 75%
- The Company retains 25%
- 2.2 The commission is calculated from the total agreed brokerage fee collected on a real estate transaction successfully closed through the Affiliate’s direct involvement.
- 2.3 To be eligible for commission, the Affiliate must register the lead and be actively involved in the negotiation and closure of the deal through KOTHAA CHA.
- Affiliate Obligations
- 3.1 Affiliates must:
- Represent the Company and its listings with integrity
- Avoid misrepresentation, unethical conduct, or side agreements
- Use only approved communication and promotional channels
- Maintain up-to-date records of communications and leads
- 3.2 Affiliates may not:
- Re-attempt to sell or promote the same property listed on KOTHAA CHA for a period of 3 months after initial engagement
- Bypass or undermine the Company by finalizing deals independently with buyers or sellers previously introduced via the platform
- Share confidential pricing, property, or client information without explicit permission
- Penalties and Termination
- 4.1 If it is found that an Affiliate has been involved in selling a previously listed KOTHAA CHA property within the restricted 3-month period, the following penalties will apply:
- 50% deduction of the Affiliate's commission on that sale
- Immediate termination from the Affiliate Program without compensation
- 4.2 KOTHAA CHA reserves the right to terminate an Affiliate at any time for:
- Breach of contract
- Fraud, misrepresentation, or unethical behavior
- Violation of Nepalese law or real estate practices
- Payment Terms
- 5.1 Commission Collection:
- All commissions (100% of the agreed brokerage or service fee) must be paid by the buyer, seller, renter, or landlord directly into the official KOTHAA CHA business account at the time of or immediately following the closing of a transaction.
- 5.2 Commission Distribution:
- Once the payment is successfully received and processed by the Company, the Affiliate will be eligible to receive their share (75% of the total commission) within 2 weeks from the closing date of the sale or transaction.
- 5.3 Payment Conditions:
- No commission shall be payable until the transaction is fully closed and verified.
- Affiliates must submit any required supporting documents to claim commissions.
- Payments are made to the Affiliate’s verified bank account.
- 5.4 Tax Compliance:
- Affiliates are responsible for declaring their income and paying any applicable taxes, including VAT or income tax, as per Nepalese law. KOTHAA CHA may withhold taxes if legally required.
- Confidentiality
- 6.1 Affiliates must treat all business, financial, and customer information as confidential.
- 6.2 Any unauthorized sharing or use of proprietary data may result in termination and legal consequences.
- Limitation of Liability
- 7.1 KOTHAA CHA shall not be liable for:
- Loss of earnings due to unclosed deals
- Delays in commission caused by external factors
- Disputes between third parties introduced by Affiliates
- Governing LawThis Agreement shall be governed by the laws of Nepal. Any disputes arising under this Agreement shall be resolved in the courts of Kathmandu.
- ModificationsKOTHAA CHA reserves the right to update these Terms and Conditions at any time. Changes become effective upon publication on the official website or affiliate portal.

- Approved Affiliate Roles and Commission Guidelines
- All the above-mentioned individuals and entities are allowed to charge service fees based on the work completed. KOTHAA CHA will deduct 25% as a platform fee from the total fee or commission earned on each transaction.
- For approved partners such as Construction Companies, Property Developers, Travel and Relocation Agencies, Interior Designers, Furniture Stores, Colleges, and Universities, they may earn up to 10% on each successful referral made to KOTHAA CHA based on the total commission or service fee received by the Company.
